Ohio High Court To Hear Cash Only Bond Case
The Ohio Supreme Court will hear oral arguments in a case filed by a bail bonds company in Licking County regarding bond procedures.
This case was joined to the case originally filed in the Ohio Supreme Court by Tony Sylvester of Sly Bail Bonds against Wayne County clerk of courts Tim Neil. The case deals with the practice of setting appearance bonds at 10% cash only. In simple terms this means that the only way for a defendant to be released on bond is to post the 10% in cash with the clerk of courts to the exclusion of all other forms of bail. This form of bail is normal business practice in Wayne, Portage and Summit counties and is a violation of Ohio’s prohibition on cash only bail. Its important for defendants to be aware of their rights and this cash only bond practice has created a new form of debtors prison in some counties in the state of Ohio.
